Terms and Conditions for North Shore Integrated Massage LLC

As of 29 May 2020, we are now North Shore Integrated Massage LLC also DBA The Haleiwa Massage Muse.

As of 1 November, 2022, we only offer on-site outcall services at your location. Our clinic is now closed.


Your use of our Massage Website and Massage Services is subject to these terms and conditions together with any additional terms and policies referred to in them.

Thank you for choosing The Haleiwa Massage Muse at North Shore Integrated Massage LLC near Haleiwa in Waialua. We provide massage therapy on the North Shore or Oahu, Hawaii.

These terms and conditions of service together with any terms and policies referred to in them constitute a legally binding agreement between you and North Shore Integrated Massage LLC and The Haleiwa Massage Muse.

This policy of Terms and Conditions was written in good-faith based on the business models of other similar companies. North Shore Integrated Massage LLC has no formal legal expertise and is not responsible for mistakes made in error. Please inform us if you find any errors or have additional questions.

USE OF OUR MASSAGE THERAPIST SITE

Our Terms govern your use of our website and our massage services. By using Our Site or Our Services, you agree to comply with these terms.

Please read our terms carefully and thoroughly. If you do not accept them, you must not make a booking through North Shore Integrated Massage LLC for any Massage Treatment.

PERSONAL DATA

In order to provide Massage Services, we may collect personal data from you. Before making a booking with us please read our privacy policy.

CONSUMER TERMS

Details on how to make a Massage Appointment are set out below.

ELIGIBLE USE

You confirm that you are of legal age to access and use Our Website and/or Our Massage Services and of legal capacity to agree to Our Terms. You are not eligible to use Our Massage Services if you are under the age of 18. We ask that all minors under the age of 18 do not submit any personal information to us. Minors of 18 years old and younger may partake in treatment by Integrated Massage only when consent has been given by a parent or guardian. In some cases, it may be required that a parent accompany the minor to their treatment.

OUR SERVICES

We provide a range of massage therapy treatments. In some instances, when the owner is unable to perform the massage service due to scheduling conflicts, injury, or illness, independent self-employed professional massage therapists may be used.  North Shore Integrated Massage LLC has no responsibility for any Massage Treatments that are provided by any therapist other than The Haleiwa Massage Muse. Each independent therapist that we use for substitution is required to have their own professional license and liability insurance.


MASSAGE APPOINTMENTS & PAYMENT

You can schedule a massage through our website or by phone, email, in-person, or text message.

Online booking is not available for medical massage or massage that is covered by insurance or other third-parties.

Your payment details may be requested at the time of booking and payment will be collected when you make an appointment online.

Full payment of the Treatment Fee is due at the time of scheduling if your Massage is booked online, and we reserve the right to request full payment before reserving your place in our schedule at any time in all other circumstances.

By making an appointment you agree to provide complete, correct and true information including without limitation billing and payment information.

Once your booking is accepted and confirmed, you will receive confirmation of your appointment by your preferred contact method (email, text message, or phone call/ voice message).

By making a booking, you are responsible for:


Full payment of the applicable Treatment Fee;

For on-call massage services: Ensuring the Therapist has access to your Designated Premises which must, in all cases, represent a suitable space in which the Massage can be performed, with all appropriate facilities (including, adequate lighting, shade, and heating); and

For on-call massage services: Ensuring the health and safety of the Massage Therapist while at your Designated Premises.

All Treatment Fees are payable through the Square Marketplace or over the telephone. As noted above, we sometimes use outside Independent Therapists and when applicable, will collect payment of Treatment Fees on behalf of the Independent Therapist to whom we charge a Fee to cover our cost of business operations.

PRICES


The price of Massage Treatments varies according to the type and duration of the Massage Treatment you book and also the location of the premises you have designated for the Massage Treatment to be provided to you. Treatment Prices are set from time to time and the Treatment Price you will be required to pay for a specific Massage Treatment will be determined by reference to the Treatment Prices in force at the date when that Massage Treatment is booked.

Full treatment menu and prices are set out on Our Website. If the service is performed as an out-call, we will agree to a travel and set-up fee ahead of time with each client.

CUSTOMER RESPONSIBILITIES

In addition to the responsibilities noted above, it is your responsibility to provide complete and accurate information at the time of booking. Failure to provide complete and accurate information may result in a rejection of your booking request, cancellation of your booking or an inability of the booked Independent Therapist to provide the Massage Treatment as requested. Such failure may also result in loss or incorrect delivery of your booking confirmation and forfeit of your prepayment.

CANCELLATION & REFUNDS

You acknowledge that you do not have any statutory right to cancel a booking made for a Massage Treatment. However, you have a contractual entitlement to cancel any booking you have made with an Independent Therapist through us in the following circumstances and on the described terms.

Subject to the cancellation being a Late or Very Late Cancellation (as described below), if you change your mind about your booking prior to the agreed appointment start time in that booking then the Massage Therapist will be willing to treat your booking as cancelled (without requiring payment of all or any part of the applicable Treatment Fee and without levying any cancellation fee) if you cancel your booking via calling 808-285-3009:

at least forty-eight (48) hours prior to the Massage Appointment Time

Massage Appointment Times falling within twenty-four (24) hours of the time of booking must be canceled within three hours of booking or else payment is subject to forfeit.

If your cancellation of a booking is:

within forty-eight (48) hours of the Massage Appointment Time; or

after the 3 hour Grace Period has elapsed

Then the Therapist will be entitled to retain one hundred percent (100%) of the applicable Treatment Fee because your cancellation represents a Very Late Cancellation. For massage services that have not been prepaid, a late cancellation or no-show fee of $40 will be charged.

You will also be charged the full Treatment Fee by the Therapist if you:

Cancel a booking other than as permitted above;

Attempt to cancel a booking on or after Massage Appointment Time; or

Fail to attend a booking at the Massage Appointment Time and/or at the Designated Premises.

A cancellation fee is charged in order to compensate the Therapist because it is not reasonable to expect that Therapist to be able to provide Massage Treatments when you cancel with short or no notice.

Cancellation fees may in our absolute discretion be waived where you have been unable to cancel a booking without incurring the cancellation fee for genuine reasons which were outside of your control.

Cancellations due to illness

We never charge a fee for late cancellations due to illness or injury. Please give us a call at any time if you become ill and we will cancel your service with no penalty. You must call as soon as possible to notify us of your illness or injury. No-shows are still subject to penalty.

EXTENSIONS AND DELAYS

If you wish to extend the time you have booked, the Therapist will try to fulfill your request, but this is not guaranteed. This is subject to the availability of the Massage Therapist and also payment of an additional charge for the extended time which may vary.

If you are delayed and unable to start the Massage Treatment at the Designated Premises at the Massage Appointment Time by more than 15 minutes then:

The Therapist may choose to be unavailable for your appointment and leave the premises. Your massage will be treated as a no-show with a $40 penalty fee or complete forfeiture of prepayment.

the Therapist is entitled to end the Massage Treatment at the time agreed when the booking was made without making any adjustment to the Treatment Fee to reflect the reduced time of the Massage Treatment; or

if you and the Therapist agree to proceed with the Massage Treatment for the full time allotted notwithstanding the delayed start time, then Independent Therapist shall be entitled to receive and you shall be obliged to pay before the relevant Massage Treatment is given, an additional charge will be calculated.


EXCEPTIONAL CIRCUMSTANCES

Every effort is made by us to provide the service booked by you, the customer. However some circumstances beyond our control may prevent this, things such as (but not limited to) :

Adverse or severe weather conditions

Road traffic accidents and delays

Vandalism and terrorism

Industrial action by third parties

Problems caused by other customers

If it was not possible to provide the booked service at the time requested due to one of the above reasons, We will try to reschedule your appointment for another time during your current stay. However, if this is not possible, a voucher of equal value to the postponed appointment will be provided for use or your money will be refunded.

North Shore Integrated Massage LLC and your Therapist will not incur any liability whatsoever in the event of delay due to circumstances out of there control.



PROHIBITED USE
You must not use our Massage Site or our Massage Services to do any of the following which are strictly prohibited:

Engage in any inappropriate behavior including but not limited to illicit or sexually suggestive remarks, sexual advances, drug use, excessive drinking and/or other inappropriate behaviors;

Restrict or inhibit any other user from using and enjoying Our Massage Services;

Infringe the privacy rights, property rights, or other civil rights of any person;

Harass, abuse, threaten or otherwise infringe or violate the rights of our Massage Therapists.
Harvest, data-mine or otherwise collect information about others, including email addresses, without their consent;

Use technology or other means to access our computer network, unauthorized content or non-public spaces;

Introduce or attempt to introduce any viruses or any other harmful code, files or programs that interrupt or otherwise or limit Our Booking Services functionality;

Damage, disable or otherwise impair our servers or networks or attempt to do the same; and

Engage in or encourage others to engage in criminal or unlawful conduct or breach these Terms including misuse of Our Massage Services for unlawful or unauthorized purposes.

You agree not to breach these Terms in any way which may result in, among other things, termination or suspension of your access to Our Massage Services.

Content on Our Website is provided for your general information purposes only. Nothing contained on Our Website or communicated any other way constitutes, or is meant to constitute advice or medical guidance of any kind. We are not considered a healthcare provider outside of our scope of practice in massage therapy nor do we provide medical advice or medical treatment outside of medical massage. References in Our Website and elsewhere to "Treatment" and "Therapy" or any similar terms do not refer to medical treatment or medical therapy outside of the scope of practice as defined in the state of Hawaii for massage therapists. The information presented on Our website and otherwise as part of Our Services is not intended to diagnose health problems or to take the place of professional medical care. Should you have a medical issue you should always consult with a qualified medical professional.

We may modify Our Terms or terminate use of Our Massage Services at any time. The Massage Treatment Prices may also change from time to time. We may also change, suspend, terminate or discontinue any aspect of Our Massage Services including our availability at any time for any reason.

In addition, external consultants (e.g., auditors, practice consultants) may on our behalf do audits and continuing quality improvement reviews of our Massage Clinic, including reviewing client files and interviewing our staff.

Massage Therapists are regulated by the state of Hawaii and other licensing boards that may inspect our records and interview our staff as a part of their regulatory activities in the public interest. In addition, as professionals, we will report serious misconduct, incompetence or incapacity of other practitioners, whether they belong to other organizations or our own. Also, our organization believes that it should report information suggesting serious illegal behavior to the authorities. External regulators have their own strict privacy obligations. In these circumstances, we may consult with professionals (e.g., Lawyers, Accountants) who will investigate the matter and report back to us.

The cost of goods/massage services provided by the organization to clients is often paid for by third parties (e.g., motor vehicle accident insurance, private insurance). These third-party payers often have the client's consent or legislative authority to direct us to collect and disclose to them certain information in order to demonstrate client entitlement to this funding.

Clients or other individuals we deal with may have questions about our goods or massage services after they have been received. We retain our client information for a mandatory minimum of ten years after the last contact to enable us to respond to those questions and provide these services.
